Services Disclaimer

Disclaimer for Dumpster Rental Service - We Can Take It

  1. Acceptance; Contract Formation. The arrangement and delivery of Services are subject to the terms and conditions set forth in this Roll Off Service Agreement (“Service Agreement”). Customer acknowledges that Customer has reviewed and understood this Service Agreement and agrees that by placing an order or accepting Services or the delivery of Equipment, a binding and enforceable agreement shall exist between We Can Take It and Customer. This Service Agreement and any supplemental terms set forth in a We Can Take It issued service-specific document, including, but not limited to, any quotation, proposal, order confirmation, service schedules, acknowledgment, or invoice, shall constitute the entire agreement between Customer and We Can Take It and supersede all previous agreements for the specified Services.

  2. Ordering Process. We Can Take It processes all orders for Services either via telephone or via our website at www.wecantakeit.com (the “Website”). Orders submitted via telephone or the Website may also be confirmed by We Can Take It via an order confirmation sent to the Customer. All orders for Services are collectively referred to as “Service Orders.” All Service Orders are accepted by We Can Take It with the understanding that each order is subject to the company’s ability to arrange for the Services through its network of independent contractors and vendors (“Service Providers”). Customer is solely responsible for contacting We Can Take It (either via telephone or the Website) to initiate Services, as well as final pickup of the Equipment.

  3. Equipment. Except as otherwise specifically stated herein, Equipment is provided on an "AS-IS" basis. We Can Take It and Service Providers make no warranties to Customer, either express or implied, including, but not limited to, warranties as to merchantability, fitness for any particular use, or that the Equipment will meet Customer’s requirements. Customer agrees to inspect Equipment upon delivery and notify We Can Take It in writing of any defects. We Can Take It will use commercially reasonable efforts to ensure timely delivery and pickup of Equipment. However, due to circumstances beyond the Service Provider’s control, including inclement weather, traffic delays, and equipment failure, We Can Take It cannot guarantee delivery times or dates.Customer acknowledges and agrees that the Equipment must be placed on a firm and stable surface and be free of obstructions for the Service Provider to perform the Services. If delivery or pickup is not possible for reasons beyond the Service Provider’s control (e.g., overloaded Equipment, blocked access), We Can Take It is entitled to charge a Dry-Run/Trip Fee of at least $200, which may increase based on additional costs incurred. Customer authorizes We Can Take It to charge this fee to the credit card on file.

  4. Damage to Equipment. While at Customer's location, Customer assumes full responsibility for the risk of loss and damage to Equipment until it is returned to the Service Provider. In the event of damage, Customer shall pay the lesser of (a) the cost of repair, or (b) the cost of replacement. Customer remains responsible for payment of all fees under this Agreement, regardless of damage or loss.

  5. Prices and Payment Terms. Prices for Services displayed on the Website are illustrative and may be modified. Prices will be confirmed at the time of the Customer’s order. All payments are due upon booking the Service on website or telephone. Customer authorizes We Can Take It to charge the credit card on file for all service fees, overage fees, and other charges.

  6. Cancellation and Cancellation Fees. To cancel a Service Order, the Customer must do so at least 24-hours before the scheduled delivery date by calling 1-855-695-JUNK. Orders canceled after this time may be subject to a cancellation fee of at least $50, which will be charged to the credit card on file.

  7. Weight Restrictions and Overage Fees. Customer agrees to comply with weight limits for Equipment. If the weight limit is exceeded, a fee of $75 per ton over the 2-ton limit will apply and be charged to the credit card on file. Customer is responsible for ensuring that no prohibited materials are placed in the Equipment.

  8. Permits. Customer is solely responsible for obtaining any required permits, licenses, or approvals for the Equipment's use. Failure to do so may result in We Can Take It retrieving the Equipment without prior notice.

  9. Prohibited Materials. Customer agrees not to deposit any prohibited materials in the Equipment, including tires, batteries, hazardous waste, etc. A list of prohibited materials is available on We Can Take It’s Website. If prohibited materials are found, the Customer will be responsible for all fees and fines associated with their disposal.

  10. Indemnification. Customer agrees to indemnify and hold harmless We Can Take It, its officers, employees, and Service Providers from any claims, losses, damages, or costs arising from the use of the Equipment, including damage to property, personal injury, or legal violations.

  11. Governing Law; Severability. This Agreement will be governed by the laws of the State of Wisconsin. If any provision is found to be invalid or unenforceable, the remaining provisions will remain in effect.

  12. Arbitration. Disputes under this Agreement will be resolved exclusively through arbitration in Wisconsin in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

  13. Assignment. Customer may not assign this Service Agreement without We Can Take It’s written consent. We Can Take It may assign this Agreement without Customer’s consent.

  14. Reservation of Rights. We Can Take It expressly reserves all rights and remedies available under applicable law.
